Reviewer and the Review Process
The Reviewer is appointed by the Minister of Education and is an individual who has recognized professional qualifications and experience working with students with special needs. The TSP Reviewer is appointed for a two year term.
Upon receipt of a complete application the Reviewer may grant a funding unit if the applicant demonstrates that all eligibility requirements are met. The Reviewer then notifies the applicant, the funded student's school board, and the Minister of Education of the decision.
The Reviewer may refuse to grant a funding unit if the eligibility requirements are not met or are incomplete. The Reviewer will notify the applicant, in writing, and include the reasons for the refusal.
This process is completed in a timely manner.
Appeal Process
The Appeal Adjudicator is appointed by the Governor in Council and must have recognized professional qualifications and experience working with students with special needs. The TSP Appeal Adjudicator is appointed for a three year term.
An applicant may appeal any of the follow decisions made by the Reviewer:
a) a refusal to grant the funding unit
b) a refusal to grant a supplement
c) the amount of the supplement granted
If an applicant wishes to appeal the decision of the Reviewer, this must be done in writing no later than 30 days after the date of the decision to be appealed. The Appeal Adjudicator will hold a hearing that provides the appellant with an opportunity to present evidence, specifically new information, relevant to their original application.
A special education private school may appeal the refusal to designate/register/renew the designation/registration of a school or the suspension/revocation of the school's designation/registration.
